What Happened?
In Bridgewater, South Dakota, in March of 1995, Donald Letcher, then 31 years old, was charged with two counts of sexually abusing his girlfriend’s daughter, who was 9 years old at the time.
Letcher allegedly coerced the girl into fondling his penis on practically every night that her mother worked the nightshift between the months of August 1992 and July 1993, when the girl was living with her mother. The girl revealed this information to the police.
Letcher was brought before the Minnehaha County Circuit Court for his trial. The prosecution filed a motion on the morning of the trial, seeking that the girl’s mother testify that Letcher had difficulties maintaining an erection and frequently manipulated himself to keep an erection. The motion was submitted when the trial was scheduled to begin. Following the defense’s argument that the prosecution had failed to reveal evidence of a claimed sexual dysfunction prior to the trial, the court decided to deny the request.
During her testimony, the child stated that the abuse started when she was eight years old, in August of 1992, and lasted when she became nine years old until July of 1993, when Letcher eventually moved out. It was her assertion that Letcher had touched her chest and forced her to rub his penis in a circular motion. She also stated that he had never ejaculated.
According to the testimony of the girl’s mother, the girl frequently experienced nightmares when Letcher was living with her. The girl and the kid’s two younger brothers were taken care of by Letcher whenever she was at work, according to her statement.
During his testimony, Letcher denied that he had abused the girl. According to his testimony, he was under the impression that the girl had either fabricated the charges or been coached due to the fact that her mother and her father, who resided in a different location and was in a relationship with another woman, were engaged in a custody dispute. According to him, he also denied having any issues with his sexual functioning.
